By turning over goods and personal effects for shipment to Amity Forwarders Inc., the shipper agrees to the terms and conditions stated herein and the Shippers declarations made in front of the invoice. No agents) and/or member(s), or employee(s) of the Amity Forwarders Inc. may alter these Terms and Conditions.

I. Shipper’s Obligations and Acknowledgements

The shipper’s guarantee that the descriptions and contents of the “Balikbayan” boxes) has been funny described in this invoice and has not been declared unacceptable for shipment/transport by the Amity Forwarders Inc. and that the boxes) are properly marked, addressed and packed to ensure safe passage with ordinary care in handling.

The shipper’s hereby agrees that the Amity Forwarders Inc, may release any item consigned by the shippers to the Amity Forwarders Inc. which Amity Forwarders Inc. has declared to be unacceptable or the shipper has undervalued for Customs purposes or misdeclared, whether unintentional or otherwise, without incurring any liability whatsoever to Amity Forwarders Inc.

The shipper’s will defend, indemnify, save, and hold Amity Forwarders Inc. harmless from all claims, damages, fines, and all expenses arising therefrom.

The shipper’s shall be liable for all costs and expenses related to the shipments) and for costs incurred either returning the shipments) or storage of the same in the Amity Forwarders Inc. storage facility pending disposition.

II. Rights of Inspection of Shipment

The shipper agrees that the Amity Forwarders Inc, has the right, but not the obligation to inspect any shipment including, without limitations, opening of the shipment and/or the “balikbayan” box(es).

III. Limitation of Liability

The shipper agrees that Amity Forwarders Inc. liability for any loss or damage to the shipment (terms including goods and personal effects and/or other items consigned to Amity Forwarders Inc, under this invoice is limited to:

1. Maximum of $200 for standard boxes (23″ x20″x17″, 20″x 20″x20″, 23 3/4″x14, 5/8 X 21 3/8*), $100 for boxes smaller than the standard boxes, or the actual amount of the content of the goods, provided the shippers will show original proof/evidence of value of the goods, such as receipt etc

IV. Consequential Damages Excluded

The shipper agrees that the Amity Forwarders Inc, shall not be liable for any consequential damages, including, but not limited to “force majeure,” or Act of God, or any special damages, indirect or direct arising from shipment of goods by the shippers, including loss of income, profit, interest, loss of market.

V. Liabilities not Assumed

The shipper acknowledges that Amity Forwarders Inc, shall exercise the best efforts to provide expeditious form of delivery in accordance with standard delivery schedules. Amity Forwarders Inc. shall not be held liable, under any circumstance, including, but not limited to “force majeure,” for delay in pickup, transport, or delivery of any shipment to the consignee.

VI. Materials not Acceptable for Shipment and/or Transport

The shipper agrees that Amity Forwarders Inc. will not accept in any form, sizes, and/or shape, or any shipment. personal effect or commercial goods (more that one dozen of any kind) and will not carry the following goods:

1. 1. Currency, Checks, Bonds, Notes. 2. Precious Metals
2. 2. Firearms (real and toys), explosives, ammunition, 4. Precious stones/minerals.
3. 3. Illegal drugs (including but not limited to marijuana, cocaine, shabu, PCP, ecstasy, barbiturates, heroin, etc.) which are restricted under any circumstances for personal use, distribution, and/or consumption without doctor’s prescriptions.

VII. Lien on Goods Shipped

The shipper agrees that Amity Forwarders Inc. will apply a lien on any goods, shipments for all freight charges, custom duties, advances, or other charges of any kind out of the transportation herewith and Amity Forwarders Inc. will hold possession of goods in the Amity Forwarders Inc, storage facility until such time the dues are paid in full. The shipper also agrees that additional fee will be applied and/or added for storage. Goods will be held for a maximum of 60 days, and will be auctioned to compensate for all outstanding fees.

VIII. Applicability

These terms and conditions shall apply to, and insure to the benefit of Amity Forwarders Inc., its agents) and/or members.
